These Terms of Service ("Terms") govern your access to and use of the websites and services operated by Tech Cave (ABN 62 992 428 919), a sole trader business owned by Keenan, Benjamin Keiran, based in Victoria, Australia. By accessing or using our websites or services, you agree to these Terms. If you do not agree, please do not use our services.
Where you use a specific product, its own product-specific terms apply in addition to these umbrella Terms. ShadowGate users should read the ShadowGate Terms of Service.
Tech Cave provides two product families:
You must be at least 18 years old, or the age of majority in your jurisdiction, to use our paid services. By using our services you confirm that you meet this requirement.
For ShadowGate, you may be required to create an account and generate API keys. You are responsible for safeguarding your credentials and for all activity conducted under your account. Notify us immediately at info@thetechcave.net if you suspect unauthorised use.
You agree not to misuse our services, including (without limitation):
Paid ShadowGate plans are billed in advance on a recurring basis via Stripe. Prices are in Australian dollars (AUD) and may change; we will provide notice of material price changes before they take effect. Subscription fees are non-refundable except as set out in our Refund Policy.
Parapunk hardware is sold as a physical product. Unless otherwise stated, hardware is covered by applicable consumer guarantees under the Australian Consumer Law. Our Refund Policy applies to returns and exchanges.
All content on our websites, and all software, documentation, branding and designs associated with our services, are owned by or licensed to Tech Cave. We grant you a limited, non-exclusive, non-transferable licence to use our services and documentation for your own internal business purposes.
Our services are provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the services will be uninterrupted, error-free, or free of harmful components. Nothing in these Terms limits any right you may have under the Australian Consumer Law that cannot be limited by agreement.
To the maximum extent permitted by law, Tech Cave will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or relating to your use of our services. Our total aggregate liability arising from these Terms will not exceed the amounts you paid to us in the three (3) months preceding the event giving rise to the claim.
We may suspend or terminate your access to paid services for breach of these Terms. You may cancel a ShadowGate subscription at any time through your account; cancellation takes effect at the end of the current billing period.
We may update these Terms from time to time. The current version will always be posted on this page with the "Last updated" date. Material changes will be communicated by reasonable notice. Continued use of the services after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the non-exclusive jurisdiction of the courts of Victoria.
